Beta User Agreement & Non-Disclosure Agreement (NDA)

1. Subject Matter & Beta Status 

(1) The User is granted access to the Beta version of transparent.ai.  

(2) This is a pre-release version provided exclusively for testing and evaluation purposes. There is no entitlement to permanent availability of the service. 

2. Confidentiality & “Stealth Mode” Obligations (NDA)

(1) The User agrees to treat all information regarding the tool, particularly its functions, algorithms, and interface, as strictly confidential.  

(2) Creating and sharing screen content (screenshots, screen recordings) as well as any public mention of the tool to third parties is strictly prohibited until September 16, 2026.  

(3) Any breach of this confidentiality shall lead to immediate exclusion from the Beta program; the Provider reserves the right to take further legal action. 

3. Active Use & Monitoring Obligation 

(1) The User commits to the active use of the tool.  

(2) The User is obliged to begin tracking and monitoring their own digital presence and relevant competitors promptly after access is granted. Persistent inactivity may result in the withdrawal of Beta access. 

4. Data Usage & Exploitation Rights 

(1) The User grants transparent.ai a non-exclusive, perpetual, and geographically unlimited right to utilize the data and results generated during use.  

(2) This specifically includes analysis for product optimization and the use of results for marketing purposes and case studies. 

5. Case Studies & Anonymization 

transparent.ai is entitled to publish the results of the usage in anonymized form as case studies. The mention of the company name or the disclosure of identifying characteristics of the User is expressly excluded without separate written consent. 

6. Disclaimer of Warranty & Liability 

As this is a Beta phase, the service is provided on an “as is” and “as available” basis. To the extent permitted by law, any liability for data loss or technical malfunctions is excluded.
